Welcome to Wavvy Wallet. By accessing or using our website, mobile application, and services (collectively, the "Services") provided by Wavvy Pay Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Wavvy Wallet is a personal finance management application that helps users track their financial transactions, manage budgets, set savings goals, and gain insights into their spending habits. Our Services include:

  • Automatic tracking and categorization of financial transactions
  • Budgeting tools and expense management
  • Savings goals and progress tracking
  • Financial reports and analytics
  • Premium subscription features

3. User Accounts

To use certain features of the Services, you must create an account. New users sign in using Google or Apple. Some existing users may continue using email and password. When using your account, you agree to:

  • Sign in only with accounts that belong to you
  • Maintain accurate and up-to-date information in your profile
  • Keep your login credentials confidential and secure
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. User Responsibilities

By using our Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Services
  • Upload or transmit viruses, malware, or other harmful code
  • Collect or harvest any information from other users without consent
  • Use the Services to send spam or unsolicited communications

5. Subscription Plans and Billing

Wavvy Wallet offers both free and premium subscription plans. Premium subscriptions provide access to additional features and enhanced functionality.

Subscription Terms:

  • Premium subscriptions are available on a monthly, annual, or lifetime basis
  • Lifetime subscriptions provide access to premium features for a minimum of 30 years from the date of purchase
  • Subscriptions do not auto-renew. You must manually initiate payment to renew your subscription
  • Payment is made via M-Pesa and must be triggered by you
  • Prices are subject to change with reasonable notice to existing subscribers

Free Trial: New users may be eligible for a free trial period. At the end of the trial, your access to premium features will expire until you subscribe.

6. Refund and Cancellation Policy

No Refunds: All payments made for Wavvy Wallet subscriptions are non-refundable. By completing a payment, you acknowledge and agree that:

  • All subscription payments (monthly, annual, and lifetime) are final and non-refundable
  • No refunds will be issued for unused portions of your subscription period
  • You are responsible for ensuring you want to subscribe before making payment

Subscription Access:

  • You will retain access to premium features for the duration of your paid subscription period
  • Once your subscription period expires, you may continue using free features or renew your subscription

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. We do not guarantee that:

  • The Services will be uninterrupted, secure, or error-free
  • The results obtained from using the Services will be accurate or reliable
  • Any errors or defects will be corrected

Wavvy Wallet is a financial tracking tool and does not provide financial advice. You are solely responsible for your financial decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVVY PAY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages arising from unauthorized access to your data

9. Indemnification

You agree to indemnify, defend, and hold harmless Wavvy Pay Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • We may delete your account and all associated data
  • Provisions that by their nature should survive termination shall survive

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last updated" date at the top of this page
  • Sending you an email notification (for material changes)

Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kenya.
